Any attorneys out there? Taxlien situation whereby IRS hasgarnished wages to the pointof poverty; remedies?
This info is for a freind whom has consulted w/ an atty. and stated that the only option is a settlement. This party does not have the money for a settlement nor enough assets to sell off to erase the tax liability. All wages garnished and personal asset(s) i.e. car has lien attached. Bankruptcy won't work due to this is non-dischargeable debt. This person understands the need to pay and has a good job-salary, but the IRS has left her/him with $333 to live on ea. month. Bascially poverty-stricken. No doubt the gov't has legal basis to due this, but, but, I believe it's unfair/ unjust to propel a person into dire straits with collection efforts. If the garnishment was not at the present level e.g. leaving this person with say $1000 to live on monthly, it would be affordable. I don't think the IRS... tax system, was setup to render a preson homeless or otherwise. Thank you for any assistance.
Obviously, I don't know all the details, but the IRS will usually levy wages only after they have been ignored for a long time. Your friend needs to come up with a payment plan, either a proposed installment payment plan (form 433D, I think) or a partial pay offer in compromise (form 656), along with a financial statement on form 433A. The forms are on the IRS web site http://www.irs.gov. Good luck.
Do I need a tax attorney foran IRS audit?
I received in the mail an audit from the IRS asking me to mail in some supporting documents for my deductions. I have the info they want. Should I hire a tax attorney to help with the audit or will I be ok mailing everything in on my own?
This is not an attorney issue. It sounds like you have the standard by mail audit that we professional tax practitioners know as a CP-2000. If you can figure out what documentation it is asking for, gather it up and send photocopies. If it states you had unreported income, state that you agree or disagree. If there is a Form 1099-C for income from cancellation of debt, you may be wise to consult a professional to determine if any part of it can be excluded.

The IRS cannot take your money to pay your POA's debts; however, the fact that your POA has had a lien placed on her accounts indicates that she may not be the best person for you to trust to handle your tax matters.
