How do I choose an estate I'm selling my house and need
to choose an estate agent.
I've never sold a house, so
this is all new! How can I
determine what sort of service
I need, and how can I find a
good quality estate agent? I'm

All estate agents are similar... Get at least three round to your house to value it - talk to them about where they would advertise, how they would handle viewings (do you want them to do it all, or do you want to show people round) - ask what their prices are. I bet all three say a different value for your house, don't just go with who says it's worth the most - ask if they've sold anything similar in your area to see what price was achieved. Look on www.rightmove.co.uk to see what else is up too. Ask if they would suggest any improvements you could/should make before putting your house on the market. Good luck. |

How is an executor to an My uncle died without leaving
a will or naming an executor
to his estate. His spouse is
deceased and he had no
children. It will fall on my
aunts and uncles to sort
things out. How do they go
about naming an executor to
his estate? Will we need a
lawyer? He lived in Texas.

How do I receive inheritance My husband's father died and
he contracted with an estate
attorney to file taxes for the
estate. How are the proceeds
distributed to my husband
after the taxes are paid? Does
the attorney present a check
to my husband or does he go to
the bank and withdraw the
remainder AFTER the state tax
is paid?
My husband and his brother are
the co-executor of the estate.
The attorney is preparing the
estate tax return for the
estate. I suppose after that
is done, my husband and his
brother disperse the funds (to
the state for tax and to the
other heirs)?

Who is the estate's personal representative? Your husband? Only the personal representative should have access to the father's accounts. There really isn't enough information about the circumstances to answer your question. ADDED: If Your husband and his brother are legally the executors, that means that they have opened probate with the Orphans' Court. Before disbursing any money from the estate, they should be filing a formal accounting with the court for audit and approval by the court of the distribution. Or, less formally, preparing what is often known as a "family settlement agreement" in which the beneficiaries provide their consent to the distribution and agree that the personal representatives can be released form their fiduciary obligations. |
