...The International Committee of the Red Cross 1958 Commentary on IV Geneva Convention Relative to the Protection of Civilian Persons in Time of War Article 4.4 states that "[1]very person in enemy hands must have some status under international law: he is either a prisoner of war and, as such, covered by the Third Convention, a civilian covered by the Fourth Convention, or again, a member of the medical personnel of the armed forces who is covered by the First Convention. There is no intermediate status; nobody in enemy hands can be outside the law. We feel that this is a satisfactory solution – not only satisfying to the mind, but also, and above all, satisfactory from the humanitarian point of view." Jean Pictet (ed.) – Commentary: IV Geneva Convention Relative to the Protection of Civilian Persons in Time of War (1958) – 1994 reprint edition. The ICRC has expressed the opinion that "If civilians directly engage in hostilities, they are considered 'unlawful' or 'unprivileged' combatants or belligerents (the treaties of humanitarian law do not expressly contain these terms). They may be prosecuted under the domestic law of the detaining state for such action". The relevance of IHL in the context of terrorism official statement by the ICRC 21 July 2005 Read full entry

How can you tell the I am sure civilians in this
latest conflict have been
killed in Lebanon. However
from what I hear many
Hezbollah are dressing in
civilian clothing. If this is
true how can you tell the
difference between civilians
and militia? Children cannot
always be demarcated as
civilian I have recently seen
old footage of Hezbollah army
marches with less than 10 year
olds carrying machine guns.
Seems like Hezbollah is trying
to create a media spin of
their own. In any case these
are factors to be considered
when trying to judge what is
going on over there.
Jake 'N' Shakes, against what
and who's going to do it?
I don't want people to think I
do not recognize that
civilians do indeed die in
war. This is unavoidable to
whatever degree. Yes, Israel
could be more careful but in
anyone remember World War 2,
whole entire cities were
leveled. Not that that is a
justification.

You are right--it is difficult to fight wars like that, and the evil people use that to their advantage. |

Civilian Body Armor: What is Can a civilian purchase class
III or IV body armor?
Where could he/she legally
purchase it?
Is the legality different from
state to state?

Well I'm no longer in Law Enforcement, I'm in CA but if I walk into a police supply store I can buy Class III no problem, I've never tried to buy Class IV but am not aware of any rules against it. |
