They will track you down by the IP you used, but really, they are targeting uploaders more then downloaders. But the Government already can access everything you have through the internet. So just cross your fingers and hope you don't get caught. |

What is the process when the Do they send a letter to your
ISP? Do they send it to the
head of your apartment
complex? Where do they send
your letter to considering
they only have your ip
address.

I think that they get all your personal information from your ISP, based on your IP address. Then, if they plan to take it to court, they probably issue a subpoena. I haven't been sued by them but I have been sent an email from my ISP warning me and threatening to disconnect me. I also have a warning box that pops up everytime I sign on. |

know plenty of people who have
downloaded for years, who are
current college students, and
they have not received any
pre-litigation letters...So, I
guess my question is, are they
lucky and are never going to
get caught? Or does the RIAA
keep tabs on everyone who has
downloaded and/or uploaded,
and they're going to
eventually catch them? or just
who they can currently catch?
So, if they stopped
downloading many months ago,
are they off the hook w/ the
RIAA?

From what I've read on the news so far, they employ people to watch P2P File sharing programs and see which users are sharing the most files. They then get that user's IP address and go through a legal proceeding and subpoena that person's ISP to get their personal information. Once this information is obtained, the RIAA's lawyers contact that person and offer them a "settlement" instead of going to court. Most likely, if the person chooses to go to court, which in fact nobody has yes, they would likely get off the hook, however, due to the high cost of legal protection, the person usually settles it outside of court with the RIAA. |

Can the RIAA find people who I know they can track
downloads made from websites
and uploads from file sharing
services, but I've heard you
can't get caught if you only
download. Is this true?

Yes.... They can snag your IP and then you are SOL.... Peer lists are used in any P2P sharing and if they have the lists, they can find every one on the share.... ISP's also monitor for traffic.... So, if you do... on the P2P app set a limit on upload and download rates so that you are not maxing out the connection and flagging the ISP through activity.... |

yeah but that is only if its your third offense as a minor but if your over sixteen then you get fined for 250,000 dollars on third offense |
